By accessing and using Tooly Iq. ("Service"), you accept and agree to be bound by these Terms of Service. These Terms govern your use of the website located at toolyiq.com and any related services.
Important: If you do not agree with these Terms, please do not access or use our Service. Your continued use constitutes acceptance.
These Terms incorporate our Privacy Policy, which explains how we collect, use, and protect your information.
Eligibility & Account Security
You must be at least 13 years of age to use our Service. By using the Service, you represent that:
- You have legal capacity to agree to these Terms
- You are not a minor in your jurisdiction
- You will not use the Service for illegal or unauthorized purposes
- You will maintain account security and notify us of any breaches
Account Security Requirements
- Use Google Authentication for secure sign-in
- Do not share account credentials
- Notify us immediately of unauthorized access
- We implement rate limiting (100 requests/minute) to prevent abuse
- All API requests are validated and sanitized
Service Plans & Credit System
Tooly Iq. operates on a credit-based system with the following packages:

Credit System Rules:
- 1 credit = 1 image processing operation (background removal OR enhancement)
- Credits are deducted immediately when processing starts
- Unused credits expire according to package duration
- No refunds for unused credits
- Cannot purchase new package with 4+ credits remaining in active package
Payment Security
- All payments processed through Stripe (PCI DSS compliant)
- We never store credit card information
- Payment intents validated with server-side checks
- Fraud detection systems in place
- All transactions encrypted with TLS 1.2+
Content & Image Processing
You retain all rights to the images you upload. By uploading content, you grant us:
- Temporary Processing Rights: Process images only to provide the Service
- Automatic Deletion: All uploaded images automatically deleted after 24 hours
- No Storage Rights: We do not claim ownership or store images permanently
- Non-exclusive License: Limited license to process images for service provision
Security Warning: Do not upload sensitive, confidential, or legally protected images. All uploads are validated for file type, size, and security threats.
Upload Security Measures
- Maximum file size: 16MB
- Allowed formats: PNG, JPG, JPEG, WebP
- File validation for image integrity
- Virus/malware scanning on upload
- Maximum resolution: 100 megapixels
- Input sanitization to prevent XSS attacks
Prohibited Uses & Security Violations
You agree not to use the Service for any unlawful purpose or violate these Terms:
Strictly Prohibited Activities
- Uploading illegal, pornographic, or infringing content
- Attempting to reverse engineer, decompile, or hack our Service
- Using bots, scrapers, or automated systems to access the Service
- Sharing accounts or credentials with others
- Creating multiple accounts to circumvent credit limits
- Uploading malware, viruses, or harmful code
- Bypassing security measures or rate limits
- Attempting SQL injection or other code injection attacks
- Violating any applicable laws or regulations
Account Termination for Security Violations
We reserve the right to immediately terminate accounts for:
- Security breaches or hacking attempts
- Payment fraud or chargeback abuse
- Distribution of malware or harmful content
- Attempting to compromise service integrity
- Violation of these Terms of Service
Service Security & Availability
We implement comprehensive security measures:
Technical Security
- Firebase Authentication with Google OAuth 2.0
- End-to-end TLS encryption for all data transfers
- Content Security Policy (CSP) headers
- X-Frame-Options and X-XSS-Protection headers
- Cross-Origin Resource Sharing (CORS) properly configured
- Regular security updates and patches
Data Security
- Images processed locally with u2net AI model
- Automatic deletion of images after 24 hours
- Secure Firebase Realtime Database for user data
- No sensitive data stored in logs
- Regular security audits and penetration testing
Service Level: We aim for 99% uptime but do not guarantee uninterrupted service. We reserve the right to perform maintenance and security updates.
AI Processing Disclaimer
The Service uses AI models for image processing and is provided "AS IS":
- We do not guarantee 100% accuracy in image processing results
- AI processing may produce unexpected or imperfect results
- We are not responsible for any damage to your images or data
- Processing times may vary based on image complexity
- No warranty for specific processing outcomes
Important: You use the Service at your own risk. We are not liable for any damages resulting from your use of the Service or AI processing results.
Limitation of Liability
To the maximum extent permitted by law, Tooly Iq. shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from your access to or use of the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Issues with third-party services (Firebase, Stripe, Google)
- Security breaches despite reasonable security measures
Our total liability to you for all claims shall not exceed the amount you paid us in the last 12 months, or $10 if you haven't made any payments.
Security Incident Response
In the event of a security incident:
- We will investigate all security incidents within 24 hours
- Affected users will be notified within 72 hours of confirmation
- We will comply with applicable data breach notification laws
- Immediate steps will be taken to contain and remediate breaches
- Measures will be implemented to prevent future incidents
Indemnification
You agree to defend, indemnify, and hold harmless Tooly Iq. from claims arising from:
- Your use of and access to the Service
- Your violation of any term of these Terms
- Your violation of any third-party right, including copyright or privacy right
- Any claim that your content caused damage to a third party
- Your violation of any applicable law or regulation
- Security breaches caused by your actions or negligence
Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the United States:
- Jurisdiction: Disputes shall be resolved in US courts
- Severability: Invalid provisions don't affect remaining terms
- Waiver: Failure to enforce rights doesn't constitute waiver
- Entire Agreement: These Terms constitute the entire agreement
- Arbitration: Disputes shall be resolved through binding arbitration
Changes to Terms
We reserve the right to modify or replace these Terms:
- We will provide at least 30 days notice before new terms take effect
- We will notify via email and/or prominent notice on our Service
- Continued use after revisions constitutes acceptance
- If you disagree with new terms, stop using the Service
